  1. Definitions

The data protection declaration is based on the terms used by European legislator for the adoption of the General Data Protection Regulation (GDPR). Our data protection declaration should be easy to read and understand for the public as well as for our customers and business partners. To ensure this, we would like to explain the terminology used in advance.

We use the following terms, among others, in this privacy policy:

4.1 Personal Data

Personal data means any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

4.2 Data Subject

Data subject is any identified or identifiable natural person, whose personal data is processed by the controller (our company) responsible for the processing.

4.3 Processing

Processing is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

4.4 Restriction of Processing

Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.

4.5 Profiling

Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

4.6 Pseudonymisation

Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

4.7 Processor

Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

4.8 Recipient

Recipient is a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

4.9 Third Party

Third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

4.10 Consent

Consent of the data subject is any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him, her or they.

  1. Legal basis for the processing

Art. 6(1) lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1) lit. b GDPR. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. Is our company subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6(1) lit. d GDPR. Finally, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. He considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

  1. Technology

6.1 SSK/TLS Encryption

For security reasons and to protect the transmission of content, this website uses either SSL or TLS encryption programme. You can recognise an encrypted connection by checking whether the address line of the browser switches from „http://“ to „https://“ and also by the appearance of the lock icon in the browser address line.

If the SSL or TLS encryption is activated, data you transmit to us cannot be read by third parties.

6.2 Data collection when visiting the website

During the merely informational use of our website, i.e. if you do not register or otherwise transmit information to us, we only collect such data that your browser transmits to our server (in so-called “server log files”). Our website collects a series of general data and information with each call of a page by you or an automated system. This general data and information is stored in the server log files. The following can be recorded

  2. the operating system used by the accessing system,
  3. the website from which an accessing system arrives at our website (so-called referrer),
  4. the sub-websites that are accessed via an accessing system on our website,
  5. the date and time of an access to the Internet site,
  6. an abbreviated Internet protocol address (anonymized IP address),
  7. the Internet service provider of the accessing system.

When using this general data and information, we do not draw any conclusions about your person. Rather, this information is required in order to

  1. deliver the contents of our Internet site correctly,
  2. optimize the content of our website and the advertising for it,
  3. to ensure the long-term functionality of our IT systems and the technology of our website, and
  4. to provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack.

Therefore, the data and information collected is, on the one hand, statistically analyzed by us and, on the other hand, it is evaluated with the aim of increasing the data protection and data security of our enterprise so as to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from any personal data provided by a data subject.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f DSVGO (GDPR). Our legitimate interest follows from the purposes for data collection listed above.

7.1 General information about cookies

We use cookies on our website. These are small files that are automatically created by your browser and stored on your IT system (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware.

In the cookie, information is stored that arises in each case in connection with the specific end device used. This does not mean, however, that we gain direct knowledge of your identity.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

  1. Contents of our Website

8.1 Contacting us / contact form

When contacting us (e.g. via contact form or e-mail), personal data is collected. Which data is collected in the case of a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of responding to your request or for contacting you and the associated technical administration. The legal basis for processing the data is our legitimate interest in responding to your request pursuant to Art. 6 (1) lit. f DS-GVO. If your contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 (1) lit. b DS-GVO. Your data will be deleted after final processing of your request, this is the case if it can be inferred from the circumstances that the matter concerned has been conclusively clarified and provided that there are no legal storage obligations to the contrary.

8.2 Application management

We collect and process the personal data of applicants for the purpose of managing the application process. The processing may also take place electronically. This is particularly the case if an applicant submits relevant application documents to us electronically, for example by e-mail or via a web form located on the website. If we conclude an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If we do not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests on our part prevent deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG).

In this respect, the data processing is carried out solely on the basis of our legitimate interest pursuant to Art. 6 Para. 1 lit. f DS-GVO

9.1 Google Analytics

Our website uses functions of the web analysis service Google Analytics. The operating company of the Google Analytics component is Google Inc, 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Cookies are used for this purpose, which enable an analysis of the use of the website by your users. The information thus generated is transferred to the provider’s server in the United States of America and stored there.

You can prevent this by setting your browser so that no cookies are stored.

Your IP address is recorded, but immediately pseudonymized. As a result, only a rough localization is possible. The relationship with the web analytics provider is based on the EU-US Privacy Shield agreement and complies with data protection regulations. Data processing is based on the legal provisions of Art 6 para 1 lit a (consent) and/or f (legitimate interest) of the DSGVO. Our concern in terms of the DSGVO (legitimate interest) is the improvement of our offer and our web presence. Since the privacy of our users is important to us, the user data is pseudonymized. The Google Analytics component is used to analyze the flow of visitors to our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our website, and to provide other services related to the use of our website.

10.1 Right to confirmation

You have the right to request confirmation from us as to whether personal data concerning you is being processed.

10.2 Right to information Art. 15 DS-GVO (GDPR)

You have the right to receive from us at any time, free of charge, information about the personal data stored about you and a copy of this data.

10.3 Right to rectification Art. 16 DS-GVO (GDPR)

You have the right to request that incorrect personal data concerning you be corrected. Furthermore, the data subject has the right to request the completion of incomplete personal data, taking into account the purposes of the processing.

10.4 Deletion Art. 17 DS-GVO (GDPR)

You have the right to request that we delete the personal data concerning you without undue delay, provided that one of the grounds provided for by law applies and to the extent that the processing is not necessary.

10.5 Restriction of processing Art. 18 DS-GVO (GDPR)

You have the right to demand that we restrict processing if one of the legal requirements applies.

10.6 Data portability Art. 20 DS-GVO (GDPR)

You have the right to receive the personal data concerning you, which has been provided to us by you, in a structured, common and machine-readable format. You also have the right to transfer this data to another controller without hindrance from us to whom the personal data has been provided, provided that the processing is based on consent pursuant to Art. 6(1)(a) DS-GVO or Art. 9(2)(a) DS-GVO or on a contract pursuant to Art. 6(1)(b) DS-GVO and the processing is carried out with the aid of automated procedures, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us.

Furthermore, when exercising your right to data portability pursuant to Article 20(1) of the GDPR, you have the right to have the personal data transferred directly from one controller to another controller, to the extent that this is technically feasible and provided that this does not adversely affect the rights and freedoms of other people.

10.7 Objection Art. 21 DS-GVO (GDPR)

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6(1)(e) (data processing in the public interest) or (f) (data processing on the basis of a balance of interests) DS-GVO.

This also applies to profiling based on these provisions within the meaning of Art. 4 No. 4 DS-GVO.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

In individual cases, we process personal data to conduct direct marketing. You may object to the processing of personal data for the purpose of such advertising at any time. This also applies to profiling, insofar as it is related to such direct advertising. If you object to us processing for direct marketing purposes, we will no longer process the personal data for these purposes.

In addition, you have the right, on grounds relating to your particular situation, to object to processing of personal data concerning you which is carried out by us for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the DS-GVO, unless such processing is necessary for the performance of a task carried out in the public interest.

You are free to exercise your right to object in connection with the use of information society services, notwithstanding Directive 2002/58/EC, by means of automated procedures using technical specifications.

10.8 Revocation of consent under data protection law

You have the right to revoke consent to the processing of personal data at any time with effect for the future.

10.9 Complaint to a supervisory authority

You have the right to complain about our processing of personal data to a supervisory authority responsible for data protection.

  1. Routine storage, deletion and blocking of personal data

We process and store your personal data only for the period of time required to achieve the purpose of storage or if this has been provided for by the legal provisions to which our company is subject.

If the storage purpose ceases to apply or if a prescribed storage period expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.

  1. Duration of storage of personal data

The criterion for the duration of storage of personal data is the respective statutory retention period. After expiration of the period, the corresponding data will be routinely deleted, provided that they are no longer required for the fulfillment or initiation of the contract.
